Terms of service

These terms govern your use of ardeva.ie (the "site") and any purchase you make from us, including all orders placed through the site. Please read them before ordering. By placing an order you agree to them.

1. Who we are
The site is operated by Ardeva Limited, registered in the Republic of Ireland (company no. 723957), registered office 88 Mornington Court, Mornington, Co. Meath, A92 V0D5, Ireland. Ardeva Limited is the seller and contracting party for all orders placed through the site, whichever market or currency you order in. VAT no.: IE4039001HH.

2. Our products
We supply living beneficial nematodes — biological pest-control organisms that are produced to order, temperature-sensitive and perishable. Because of this, our ordering, delivery and returns arrangements are specific to live product. Please read our Shipping & Delivery Policy and Refunds & Returns Policy, which form part of these terms.

3. Ordering and our contract with you

  • Product is produced and imported against a weekly order cycle with a cut-off of 10:00 (Irish time) on Wednesday. Orders placed after the cut-off roll into the next cycle.
  • When you place an order you'll receive an acknowledgement. This is not acceptance of your order. A binding contract is formed only when we send you an order/dispatch confirmation. We may decline or cancel an order (for example if product is unavailable, there's a pricing error, or delivery to your area isn't feasible), in which case we'll refund any payment in full.
  • You can cancel or amend for a full refund up to the 10:00 Wednesday cut-off. After that your order is committed to production and our Refunds & Returns Policy applies.

4. Prices, VAT and currency
All prices are in euro and include VAT at 23%. Delivery charges are shown at checkout. We try to keep prices accurate but if we spot a genuine error we'll contact you before proceeding.

5. Delivery
Delivery is to addresses in the Republic of Ireland, per the weekly cycle set out in our Shipping & Delivery Policy. Orders are packed and dispatched on our behalf by a fulfilment partner. As the product is alive and perishable, you must ensure someone is available to receive it and refrigerate it promptly.

6. Correct use, storage and results
Nematodes are living organisms whose performance depends on correct storage and application. You are responsible for storing the product at 2–8°C, applying it by its use-by date, and following the application guidance (dosage, timing, soil temperature and moisture). Any technical or application information we provide — on the site, on packaging or in support — is general guidance to help you choose and use the product; it is your responsibility to confirm suitability for your situation. Biological controls reduce target pest populations under suitable conditions but are not guaranteed to eradicate a pest. This does not affect your legal rights if the product supplied was faulty.

7. Trade and business accounts
Purchases by businesses are made under our separate trade terms (including, where agreed, net-30 payment by bank transfer). The consumer cancellation rights referred to in our Refunds & Returns Policy do not apply to business purchases.

8. Your consumer rights
Nothing in these terms affects your statutory rights as a consumer, including the right to goods that are of satisfactory/acceptable quality, as described, and fit for purpose (Republic of Ireland: Consumer Rights Act 2022; Northern Ireland: Consumer Rights Act 2015).

9. Our liability
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for any of your statutory rights as a consumer. Subject to that, we are not liable for losses that were not foreseeable, or for business losses (such as loss of profit or crop loss) where you buy as a business rather than a consumer, except as agreed in your trade terms.

10. Website use and intellectual property
The content of the site (text, images, infographics, logos and branding) is owned by or licensed to Ardeva and may not be copied or reused without our permission. You agree not to misuse the site or use it for any unlawful purpose.

11. Governing law
These terms, and any order placed through the site, are governed by the laws of the Republic of Ireland, and the courts of the Republic of Ireland have jurisdiction, subject to the paragraph below.

If you are buying as a consumer resident in Northern Ireland or elsewhere in the UK, this choice of law does not take away the protection given to you by the mandatory consumer-protection laws of the UK/Northern Ireland, which continue to apply alongside these terms.

12. Changes
We may update these terms from time to time. The version in force when you order is the one that applies to that order.
